As we mentioned in last month’s RSA Reporter, the State Legislature will be looking to create additional tenant protections this year and RSA has launched a thorough public relations campaign to educate the public throughout the entire State on its negative consequences.
As if the Housing Stability and Tenant Protection Act (HSTPA) of 2019 from the pro-tenant Democrats in the State Legislature did not cause enough damage, the same progressive lawmakers have announced their number one priority for the 2020 legislative session: Just Cause Eviction.
In late January, RSA launched its latest educational public relations campaign, a three-part, animated video series on YouTube entitled Just Cause-- Eviction: Losing Control of Your Property. The videos, approximately 90 seconds long each, dig deep into the details of the proposed legislation, which in reality would create universal rent control throughout the entire State.
Tenants in all buildings, including two-family homes, would be eligible for a “lease for life.” As long as the tenant is paying the rent and not violating their lease agreement in any way, property owners would not be able to remove their tenants under any circumstances and they could realistically live there for as long as they choose to do so.
Permanent tenancy through universal rent control would be devastating, not only to free market apartments in New York City, but to rental property owners in all of New York State. Furthermore, the proposed bill would limit rent increases for all tenants in both regulated and non-regulated apartments regardless of their income. By capping rent increases, the legislation would effectively create rent regulation for non-regulated apartments.
Not only does the HSTPA already severely limit an owner’s ability to make necessary repairs, but capped rents as result of Just Cause Eviction would place an even bigger stranglehold on owners as all building operating expenses continue to rise. If owners are no longer able to perform necessary repairs to their buildings and apartments, it would be devastating for local businesses and contractors who would ultimately lose the business and work they were accustomed to prior to 2019.
In addition to detailing the negative components of Just Cause Eviction, the videos urge building owners, contractors, realtors, bankers and local community groups in the entire State to contact Governor Andrew Cuomo and their local representatives in the State Legislature to oppose this extreme proposal.
Because the legislative session is expected to end by Memorial Day weekend this year, we expect pro-tenant lawmakers to fight for Just Cause Eviction to pass as part of the State budget in April. As a result, time is not an ally and we call on RSA members to act quickly and contact your State representatives. We also ask that you spread the word about Just Cause Eviction to your fellow rental property owners, contractors and local businesses throughout the City and State.
