Building owners should have complied with the bedbug electronic filing requirements period by December 31, 2020.
In accordance with Local Law 69 of 2017, owners or building managers should have collected bedbug infestation histories from all tenants. The most recent electronic filing period through the City Department of Housing Preservation and Development (HPD) required infestation histories between November 1, 2019 and October 31, 2020. Owners were then required to electronically file this information with HPD between December 1, 2020 and December 31, 2020. It is important to remember that electronic filing is still required even when there is no reported bedbug activity in a particular apartment.
A copy of the submitted electronic form must be distributed to each tenant upon each lease renewal or commencement of a new lease, or posted in a prominent location of the building within 60 days of filing. Building owners must also either distribute or post a brochure (in a prominent location in the building) that provides information about the prevention, detection, and removal of bedbugs. The notice can be found on RSA’s website at www.rsanyc.org under “Bedbugs” under the “Resources” tab on the website homepage.
Please visit HPD’s Bedbugs landing page located at https://on.nyc.gov/35pIQ7V to view the reporting requirements (or see page 7of the November 2020 RSA Reporter) and fill out the Annual Bedbug Report filing application. Please be aware that the online application will only allow validly registered property owners and managing agents to disclose a building’s bedbug infestation history. A building’s property registration should have been completed by the extended deadline on November 1st.
HPD will issue fines for failure to comply with Local Law 69. There have been no filing grace periods provided by HPD as a result of COVID-19. However, we urge you to document and keep on record all attempts to comply with the bedbug reporting requirements.
